●Consulting – As someone who has taught and studied criminal law, criminal procedure, and evidence on a regular basis for over twenty years, I can provide consulting services in these areas. These services can include providing written research memos, expert legal reports (to the extent permitted by local rules), and expert legal testimony at depositions, hearings, and trials (again, to the extent permitted by local rules). I can provide these services in civil cases as well as criminal. For example, I have consulted in one case brought by a landlord against a local government claiming that the administrative warrant scheme pursuant to which some of his properties were searched violated the Fourth Amendment. I am also available as an expert in section 1983 actions where there is claim of excessive force or some other constitutional violation.

●Brief writing and editing – Brief writing is a craft like any other, one in which I am highly skilled. From my first year of law school, when I was awarded the prize for the best moot court brief in my entire first-year class, to my time as an appellate defender, when I briefed dozens of cases for my clients in the New York and federal appellate courts, up through my academic career, during which I have authored or co-authored briefs amicus curiae in high profile U.S. Supreme Court cases, I have been gifted with the ability to craft excellent briefs. I am available to research and write discrete sections of briefs, and to review and edit briefs written by others. Supreme Court cases in which I have submitted amicus briefs are:

▪City of Grants Pass v. Johnson, No. 23-175, U.S. Supreme Court (filed Mar. 4, 2024) (co-authored with a law school Supreme Court clinic)

▪United States v. Tsarnaev, No. 20-443, U.S. Supreme Court (filed Aug. 27, 2021) (principal author) [the “Boston Marathon bomber” case]

▪Walker v. United States, No. 19-373, U.S. Supreme Court (filed Jan. 13, 2020) (co-authored with two fellow law professors)

▪Gamble v. United States, No. 17-646, U.S. Supreme Court (filed Sept. 11, 2018) (co-authored with three fellow law professors)

▪Trump v. Hawaii, No. 17-965, U.S. Supreme Court (filed Mar. 30, 2018) (co-authored with another law professor) [the second “travel ban” case]

▪Trump v. Int’l Refugee Assistance Proj. and Trump v. Hawaii, Nos. 16-1436, 1540, U.S. Supreme Court (filed Sept. 18, 2017) (co-authored with another law professor) [the first “travel ban” case]
